Noncompete agreements have long been a contentious issue in the health care industry, often restricting physicians' abilities to change employers or start their practices freely. A recent rule change by the Federal Trade Commission (FTC), however, bans noncompete agreements for most employers and employees, and will have profound implications for physicians practicing in Indiana. The FTC rule change comes on the heels of a 2023 Indiana law, Senate Enrolled Act (SEA) 7 (2023), which provides that a primary care physician and an employer may not enter a noncompete agreement, and places new requirements on noncompete clauses for other physicians.
