$15 million medical malpractice award upheld
A federal judge has upheld a $15 million medical malpractice verdict against a Carmel imaging center, finding the $1.25 million damages cap set by Indiana’s Medical Malpractice Act did not apply because the center had not paid the PCF surcharges required to make it a qualified provider under the Act. Nor had the Center for Diagnostic Imaging, Inc., given the patient notice before the procedure that the physician performing it was an independent contractor.
