The Indiana Patient’s Compensation Fund has established its annual surcharge by issuing a bulletin signed by the Commissioner, in her capacity as the PCF's administrator. However, House Enrolled Act 1623, which was passed during the 2023 session of the General Assembly, requires that the amounts of certain “fines, fees, and civil penalties” not delineated in statute must be established by administrative rule. 760 IAC 1-21 details surcharge rates for independent ancillary providers, nursing homes, and ancillary providers. The surcharge rates for physicians and hospitals are established through an “actuarial program” under Ind. Code 34-18-5-2 and are published in 760 IAC 6-1-9.
As shown below, there is no change in the rates from the previous year.

HOSPITAL RATES
The surcharge calculations must be completed with the Hospital Calculation Worksheet, available at
www.in.gov.
Please note that physicians employed by hospitals continue to pay 100% of the appropriate surcharge for the physician’s specialty class. Hospitals lacking a risk management program continue to receive a 10% penalty of the subtotal of the surcharge due. Hospitals with more than 500 beds should continue to add a 3% multiplier to the subtotal of the surcharge due. If you have any questions or concerns about these rates,

Additional Notice to Certificate Filers: Pursuant to I.C. 34-18-3-5, the Department may approve a certificate received between 91 and 180 days late. Filers must submit an appeal letter to
PCF-COI@idoi.IN.gov after entering a late certificate. Effective February 1, 2026, if an appeal letter is needed for a certificate filed through the PCF’s eFiling system, it must be received within five (5) business days from the date the certificate is created, or the certificate will be rejected.
