Program description:

The recent federal Supreme Court decision on Dobbs v. Jackson Women’s Health Organization to overturn Roe v. Wade has left abortion laws up to individual states. Thus, the national landscape around abortion has changed dramatically and states have constructed a web of abortion laws and regulations that restrict or support whether, when, and under what circumstances providers can offer abortion care and a pregnant individual can obtain an abortion. 

There is now much confusion around women’s reproductive choices and compliance with new laws.  A panel of attorneys from Krieg DeVault will lead this presentation, sharing updates with members to dispel any confusion.

Objectives:

At the end of this webinar, participants will be able to:

  1. Explain Indiana’s new abortion law, Senate Enrolled Act (SEA) 1.
  2. Describe the current status of filings initiated by the Office of the Indiana Attorney General to lift injunctions that were in place before the U.S. Supreme Court’s Dobbs ruling regarding several abortion laws on the books in Indiana.
  3. Discuss the enforcement mechanisms that will take effect Sept. 15 per Indiana’s new abortion law, Senate Enrolled Act (SEA) 1.

About our speakers:

Grant Achenbach represents the firm’s clients before the Indiana General Assembly and state administrative agencies, advising clients on legislative and executive branch lobbying strategy, policy development, and coalition building. His health care lobbying experience is an asset to the firm, representing clients in matters involving medical malpractice liability, telehealth, employment contracting, health insurance matters, scope of practice and licensure, and health care price transparency requirements. Prior to joining Krieg DeVault, Grant served as the Director of Government Relations for ISMA.

Shelley Jackson concentrates her practice in the areas of health law, employment law, professional license defense and data privacy and security. She brings a diverse set of professional experiences to her work, including time spent both in a law firm setting and in-house as an assistant general counsel and chief privacy officer for a multi-national corporation. Whether providing day-to-day advice, navigating disputes, or representing clients in high stakes matters, Shelley combines broad substantive expertise with cost-effective, practical strategies. She routinely advises and represents clients in compliance and enforcement matters before administrative agencies, such as the Indiana Professional Licensing Agency, U.S. Equal Employment Opportunity Commission, U.S. Department of Labor, and U.S. Drug Enforcement Administration.

Brandon Shirley has a diverse knowledge of federal and state regulations. He has extensive experience with state and federal Medicaid laws, regulations, policies, waiver programs, audits and administrative appeals, having previously served in top-level legal positions with the state of Indiana. His practice extends to Medicaid managed care policies, audits and disputes. He assists clients investigating and appealing government overpayment determinations or other Medicare or Medicaid sanctions, as well as with internal investigations of noncompliance issues involving Medicare and Medicaid billing. He has additional experience with Medicare and Medicaid pharmacy issues, including 340B drug pricing, telehealth and telemedicine, state and federal site surveys, Department of Health and licensure issues, and federally qualified health centers. Brandon specializes in Medicare and Medicaid fraud and abuse laws, including establishing arrangements that comply with the Anti-Kickback Statute and Stark Law.
