Sen. Busch, Rep. Manning named ISMA Legislators of the Year

(NOBLESVILLE) – The Indiana State Medical Association honored two state legislators at its annual convention Sunday for leading the successful effort to ban noncompete clauses in most physician contracts.

Sen. Justin Busch (R-Fort Wayne) and Rep. Ethan Manning (R-Logansport) shared ISMA’s Legislator of the Year award in recognition of their work on Senate Enrolled Act 475, authored by Busch and sponsored by Manning in the House. SEA 475 prohibits noncompete clauses in all new physician contracts with hospitals or hospital systems entered on or after July 1 of this year.

Noncompete clauses were already banned for primary care physicians, regardless of their employer, but existing law did not offer similar protections to specialists, forcing some physicians to leave their communities in order to continue practicing. SEA 475 is expected to prohibit these restrictions for a majority of physician contracts signed after its effective date. The bill passed the Senate 46-4 and the House 65-21, and was signed into law by Gov. Mike Braun on May 6.
